Protecting Your Freedom | Preventing Strikes
The three strikes law, officially the state's criminal sentencing law approved in 1994 as Proposition 184, was a major change in California law. If convicted of a third strike offense such as rape, you could be facing a minimum of 25 years and up to life in prison. Prison time for the third strike is not awarded good behavior in the same way as good behavior for other state or federal other crimes. Additionally, any sentences are consecutive (in a row) rather than concurrent (at the same time).
"If you have two strikes against you, you may want to consider trying to get one of the strikes removed. Two strikes is a terrible burden to carry around." — Attorney Gerald Carrasco
Unfortunately, the third strike does not need to be for a crime which would, on its own, carry 25 years to life. It just needs to be the third qualifying crime with a guilty verdict. The strike offenses include, but are not limited to:
- Arson
- Assault with a deadly weapon or assault of a police officer
- DUI with serious bodily injury
- Kidnapping
- Rape
- Receiving stolen property
- Residential burglary
- Robbery

Robbery is one of the criminal charges that, if found guilty, could result in a strike. There are two main ways we would fight this case:
- Fight the robbery charge
- Negotiate to have the current strike, or previous strikes, dismissed or downgraded to a non-strike offense
